Terms of Service

BayAnswer is operated by Cody Espudo, doing business as BayAnswer ("BayAnswer", "we"), 6077 Martinez Ave, Riverside, CA 92509.
1. Service
BayAnswer provides AI call answering, appointment booking, call summaries, and missed-call text messaging for business use by auto repair shops.
2. Trial and billing
Plans include a 14-day free trial, and a card is required. Unless you cancel before the trial ends, your card is charged the plan price monthly in advance. Minutes over your plan's allowance are billed at $0.20 per minute. Fees are non-refundable except where required by law or at our discretion.
3. Cancellation
You can cancel anytime through the billing portal. Service continues until the end of the paid period.
4. Your responsibilities
You are responsible for the accuracy of the shop information you provide, for obtaining any consent required for call recording in your jurisdiction (we provide a disclosure at the start of each call), for using SMS features only to message people who contacted you, and for complying with the TCPA, CTIA guidelines, and carrier rules. You may not use BayAnswer for unsolicited marketing calls or texts.
5. AI limitations
AI answers may sometimes be incomplete or wrong. BayAnswer does not give binding quotes, diagnoses, or safety advice, and it tells callers with emergencies to call 911. You remain responsible for your customer commitments.
6. Acceptable use
No unlawful, harassing, or deceptive use. You may not reverse engineer the service or resell it without written permission.
7. Disclaimer and liability
The service is provided "as is." To the extent permitted by law, our total liability is limited to the fees you paid in the 3 months before the claim, and we are not liable for lost profits or indirect damages.
8. Governing law
These terms are governed by the laws of the State of California, and disputes will be resolved in the state or federal courts located in Riverside County, California.
